I’m committed to protecting your personal information and your right to privacy. If you have any questions or concerns about my policy, or my practices with regards to your personal data (the term “personal data” comprises all data that can be used to personally identify you), please contact me at hi@moer.tel, anytime! I’ve been working as a Data Engineer since 2011 and have a lot of experience both technically and legally in how to properly and responsibly handle personal data.
However, don’t just take my word for it; this Privacy Policy governs the privacy policies and practices of my Etsy shop. Please read it carefully as it will help you make informed decisions about sharing your personal information with me. <3
I last updated this Privacy Policy on 03 July 2021.
+++ Information I Collect +++
To fulfil your order, you must provide me with certain information (which you authorised Etsy to provide to me), such as your name, email address, postal address, payment information, and the details of the product that you’re ordering. You may also choose to provide me with additional personal information (for signing your prints, for example), if you contact me directly.
+++ Why I Need Your Information and How I Use It +++
I rely on a number of legal bases to collect, use, and share your information, including:
+ As needed to provide my services, such as when I use your information to fulfil your order, to settle disputes, or to provide customer support.
+ When you have provided your affirmative consent, which you may revoke at any time, such as by signing up for my mailing list.
+ If necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law.
+ As necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as 1) providing and improving my services. I use your information to provide the services you requested and in my legitimate interest to improve my services; and 2) Compliance with the Etsy Seller Policy and Terms of Use. I use your information as necessary to comply with my obligations under the Etsy Seller Policy and Terms of Use.
+++ What rights do you have as far as your information is concerned? +++
You have the right to receive information about the source, recipients and purposes of your archived personal data at any time without having to pay a fee for such disclosures. You also have the right to demand that your data are rectified or eradicated. If you have consented to data processing, you have the option to revoke this consent at any time, which shall affect all future data processing. Moreover, you have the right to demand that the processing of your data be restricted under certain circumstances. Furthermore, you have the right to log a complaint with the competent supervising agency.
+++ Information Sharing and Disclosure +++
I share your personal information for very limited reasons and in limited circumstances, as follows:
+ With Etsy. I share information with Etsy as necessary to provide you my services and comply with my obligations under both the Etsy Seller Policy and Etsy Terms of Use.
+ Service providers. I engage certain trusted third parties to perform functions and provide services to my shop, such as delivery companies (e.g. DHL and DeutschePost). I will share your personal information with these third parties, but only to the extent necessary to perform these services.
+ Compliance with laws. I may collect, use, retain, and share your information if I have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others.
+++ Data Retention +++
I retain your personal information only for as long as necessary to provide you with my services and as described in my Privacy Policy. However, I may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements. I generally keep your data for the following time period: 10 years. (Thank you, German tax laws...)
+++ Transfers of Personal Information Outside the EU +++
I may store and process your information through third-party hosting services in the US and other jurisdictions. As a result, I may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. My shop uses, in particular, tools from companies based in the USA (e.g. Mailchimp for sending newsletters and GoogleAnalytics for... well... analytics :)). When these tools are active, your personal information may be transferred to the US servers of these companies. I must point out that the USA is not a safe third country within the meaning of EU data protection law. US companies are required to release personal data to security authorities without you as the data subject being able to take legal action against this. The possibility cannot therefore be excluded that US authorities (e.g. secret services) may process, evaluate and permanently store your data on US servers for monitoring purposes. I have no influence over these processing activities.
+++ How to Contact Me +++
For purposes of EU data protection law, I, Stefanie Grunwald, am the data controller (muaha) of your personal information. If you have any questions or concerns, you may contact me at hi@moer.tel. Alternately, you may snail-mail me at: Stefanie Grunwald, Steinschanze 6, 20457 Hamburg, Germany.
